5. Shipping

• Risk of loss and title for products purchased pass to you upon our delivery of the product to the carrier.
• We are not responsible for delays caused by the shipping carrier, customs, or other circumstances outside of our reasonable control.

6. Returns, Refunds, and the 30 Day Money Back Guarantee

• You may request a return or refund within 30 days of the delivery date of your order.

7. Warranty

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.

Arbitration will be administered by a recognized arbitration provider in accordance with its rules then in effect, and will take place in, or be otherwise connected to, New York, unless you and The Bulan agree otherwise. The arbitrator's decision will be final and binding, except for a limited right of appeal under applicable arbitration law.

Class Action Waiver. YOU AND THE BULAN AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and The Bulan agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

Opt-Out. You may opt out of this arbitration agreement by sending written notice to info@thebulan.com within 30 days of first accepting these Terms, clearly stating that you wish to opt out of arbitration.

Severability. If any part of this arbitration agreement is found unenforceable, the remainder will continue to apply, except that if the Class Action Waiver is found unenforceable, the entire arbitration agreement shall be null and void.

16. Governing Law

These Terms and any dispute arising out of or related to them or the Services shall be governed by the laws of the State of New York, without regard to its conflict of laws principles, except to the extent governed by the Federal Arbitration Act with respect to Section 15. To the extent any dispute is not subject to arbitration or properly brought in small claims court, you agree to the exclusive jurisdiction of the state and federal courts located in New York.

We may modify these Terms at any time. The updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of the Services after any changes constitutes your acceptance of the revised Terms.
